Consumer Health Data Privacy Policy

Scope

This policy describes how Asymmetric Health, PLLC handles consumer health data under the Washington My Health My Data Act, chapter 19.373 RCW.

It applies to both websites we operate: asymmetrichealth.com, our practice website, and shop.asymmetrichealth.com, our online store.

It does not apply to protected health information. The health information we create and maintain about you as a patient is governed by HIPAA and by our Notice of Privacy Practices.


Consumer Health Data We Collect, and Why

Contact information tied to a guide request or a consultation request. If you download an educational guide we collect your email address. If you request a consultation we collect your name, email address and telephone number. Each guide and each request identifies a health topic, so the request tells us the subject you are interested in or that you are seeking health care services. We use this information to send you what you asked for and to contact you.

Inquiries you send us directly. If you telephone, text or leave a voicemail before you become a patient, and you describe symptoms, a condition or the care you are looking for, that information is consumer health data. We use it to answer you and to arrange care if you decide to proceed.

Evaluation purchases. If you purchase an evaluation, that transaction indicates that you are seeking health care services. It is handled in our patient portal and becomes part of your record.

Online store purchases. Our store sells injection supplies and similar products to the public. A purchase can indicate that you are seeking health care goods or services. We collect the order, delivery and contact information you enter at checkout, and we use it to fulfill and support the order.

Symptom screening questionnaires on our practice website are scored in your browser. Your answers are not transmitted to us or to anyone else.


Sources

We collect consumer health data directly from you: through the forms and purchase pages on our two websites, and through the telephone, text and voicemail messages you send us.

We do not buy consumer health data, we do not obtain it from data brokers, and we do not collect it from any other third party.


What We Share, and With Whom

We share consumer health data only as needed to provide what you asked for and where the law requires it. We do not sell consumer health data.

AmplifyDPC, our patient relationship platform, receives guide requests and consultation requests submitted through our forms.

Hint Health, our patient portal and billing platform, processes evaluation purchases.

Spruce Health, our telephone and secure messaging system, carries the calls, texts and voicemails you send us and the messages we send you.

Shopify, the platform that operates our online store, processes store orders and the information you enter at checkout.

Bankful, the payment processor for our online store, processes store payments.

Professional advisors and authorities, meaning attorneys, accountants, auditors and regulators, and any disclosure required by law.

We do not share consumer health data with any affiliate.


Your Rights

Under RCW 19.373.040 you have the right to:

Confirm and access. Ask whether we collect, share or sell consumer health data about you, and receive a copy. This includes a list of every third party and affiliate we have shared or sold it to, and an email address or other online mechanism you can use to contact each of them.

Withdraw consent. Withdraw your consent to our collection and sharing of your consumer health data at any time.

Delete. Have your consumer health data deleted. We will delete it from our records and notify anyone we shared it with.

Appeal. If we refuse a request, we will tell you why and how to appeal. If we deny your appeal, we will give you a way to contact the Washington Attorney General to submit a complaint.

We will respond within 45 days of receiving a request. We may extend that period once by another 45 days where reasonably necessary, and if we do we will tell you why before the first period ends. You will not be charged for exercising these rights, and we will not treat you differently for doing so. If you withdraw consent or ask us to delete this data, we may no longer be able to send you what you requested, schedule a consultation, or complete a store order.

Changes to This Policy

We will not collect, use or share consumer health data for a purpose not described here without first disclosing that purpose and obtaining your consent.

The effective date above reflects the version currently in force. The review date reflects the last time we checked this policy against our practices.
